OCCUPATIONAL DOCTOR'S SERVICE
Law No. 10 237 dated 18.02.2010 "On Occupational Safety and Health", VKM No. 639 dated 07.09.2016 "On defining the rules, procedures, and types of medical examination tests to be conducted depending on the work process of the employee, as well as the manner of operation of the occupational health service", mandate the obligation of the existence of an occupational health physician, who will conduct medical checks at the start of employment and periodically at the subject, documenting potential risks for occupational diseases in the workplace. TOSHA offers the Occupational Health Doctor Service to every interested subject, in compliance with the legal framework and the following duties.
SOME OF THE DUTIES OF THE COMPANY DOCTOR ARE:
- Basic medical check-up.
- Ekzaminimet individuale.
- The completion of the "Declaration on the Alignment of the Person's Health Condition with the Work Performed" at the conclusion of the occupational medical visit. This document indicates the degree of alignment between the employee's health condition and the work to be performed, as well as special notes and recommendations for the employer.
- Determines the type of professional medical examination to be performed.
- Refers that an employee must undergo additional professional medical examinations.
- During every occupational medical visit, the occupational health physician requests, if deemed necessary, additional information from the employee’s family doctor, who is subject to occupational medical examination, for the purpose of completing the information in the “Occupational Health Check Report”.
- If the results from the occupational medical examination are not sufficient to determine the alignment of the employee's health condition with the work to be performed, the occupational doctor will refer the employee to other specialist doctors for further professional medical examinations.
- If, during the occupational medical examination at work, a disease unrelated to work is diagnosed and has not been previously diagnosed or treated, the occupational doctor refers the employee for further follow-up by their family doctor. The new diagnosis and the results of the examinations performed are documented and retained by the occupational doctor.
- The occupational doctor recommends in the occupational health record the mandatory use of collective and individual protective equipment, as well as specific measures for the protection of the employee's health at the workplace.
- If it's declared that an employee's health condition is not compatible with the work to be performed, the occupational doctor acts as follows:
- Describes the medical treatment, provides recommendations for rehabilitation and continuous follow-up, according to the provisions of the current legislation on work accidents and occupational medicine, by applying the referral system for occupational healthcare.
- Nëse është e nevojshme, dërgon punëmarrësin për kontroll te mjeku i familjes/ mjeku tjetër specialist për trajtim jashtë institucionit, sipas sistemit të referimit të kujdesit shëndetësor.
- Recommends the necessary measures for protection at work.
- Recommends the appropriate time for conducting additional medical examinations after the completion of a treatment. This is done to assess whether health problems caused by harmful workplace factors, or health problems that have led to an accident or occupational disease, have been eliminated and if the employee's health condition is compatible with the work to be performed.
- Employees who are or have been exposed to risk factors in the workplace and are suspected of having an occupational disease can request a specialized occupational health check-up from the occupational doctor/occupational disease doctor or from other specialist doctors, according to the provisions of the current legislation on this matter.
- If an occupational disease is suspected after the professional medical examination at work, the occupational doctor completes the "Report for Suspected Occupational Disease." Along with supporting data (results of the professional medical examination, analyses and medical tests, and the patient's occupational history), they refer the employee to the Regional Cabinet of Occupational Diseases or the Cabinet of Occupational Diseases at the "Mother Teresa" University Hospital Center in Tirana for further evaluation.
